An inmate has been freed of a charge of buggery after the cellmate he’s alleged to have sexually assaulted expressed a desire to drop the case.

The accused, whose name Loop News is withholding for his safety, was freed in the Home Circuit Court in Kingston on Monday.

The complainant told the court that he wanted to end the case because he was tired of coming to court. He said he was not threatened to take the course he did nor was he forced or promised any favours.

The alleged incident occurred on the morning of April 14, 2013 at the Horizon Remand Centre.

The complainant was at the facility on charges of rape, illegal possession of a firearm and kidnapping. The accused man was in on a charge of rape.

It is alleged that the complainant was sleeping when he felt a blow to the back of the neck that caused him to lose consciousness.

He allegedly revived to find the accused man sexually assaulting him.

The complainant is said to have struggled with his attacker but was threatened with a sharp object.

The matter was subsequently reported and the accused man charged.

A medical report indicates that the complainant was, in fact, sexually assaulted.

The men are currently serving time behind bars on the charges for which they were originally arrested.
